The legal confrontation between the Commodity Futures Trading Commission (CFTC) and Murtuza Kazmi, along with Traders Global Group Inc., operating as “My Forex Funds,” continues to unfold in the New Jersey District Court. The case, which has garnered significant attention, recently saw a heated exchange over the production of information.

On August 20, 2024, the CFTC addressed a letter to the Special Master overseeing the case, expressing its determination to proceed with the evidentiary hearing scheduled for September 19. The CFTC is eager to present its case against the defendants, who have been pushing for additional disclosures.

The core of the dispute lies in the defendants’ request to access privileged documents, which the CFTC argues are irrelevant to the core issues of the case and are protected under legal privileges, such as work product protections and attorney-client privilege. The CFTC contends that allowing the defendants’ “unsupported quest” for these documents would only serve to delay the proceedings further and insists that the evidentiary hearing should proceed as planned.

The defendants, on the other hand, have urged the court to conduct an in-camera review of specific internal communications between CFTC attorneys. They argue that these documents could be crucial to their defense, although they have not provided a clear rationale for how these communications might fall outside the scope of standard legal protections.

This legal battle dates back to August 28, 2023, when the CFTC filed a Complaint for Injunctive Relief, Civil Monetary Penalties, and Other Equitable Relief against Traders Global Group Inc., both its New Jersey and Canadian entities, and Murtuza Kazmi. The CFTC’s complaint alleges violations of the Commodity Exchange Act and related Commission Regulations.

As the case progresses, the tension between the need for information disclosure and the protection of privileged communications will continue to shape the courtroom dynamics.
